1. you are french and your partner is french as well, you'll need:
- birth certificate (less than 3 months-old)
- photocopy of ID, such as passport, drivers license or European ID card.
- declaration of marital residency(déclaration sur l'honneur du lieu de résidence commune), this letter must be sign by both partners. [Declaration of Marital Residency]
- a letter on the honor (attestation sur l'honneur), indicating celibacy, this letter must be sign by both partners. This document is different from the contract. [Letter on the Honor]
- PACS contract (Convention de PACS). You will need to write a letter, where you state in which conditions you want to get PACSed, the complexity of this contract is going to be based on the material goods of the partners. A detailed letter is necesary if the parties involved want to be sure their goods aren't affected the day they want to void their PACS. If you are envisioning this type of letter, I will recommend you to seek for a notary with experience. This contract has to be done whether you have or do not have goods. [PACS Model Contract]
- birth certificate, translated and legalized (legalized means with the apostille). The birth certificate must be less than 3 months-old.
- affidavit of law (certificat de coutume), also known as certificate of freedom to marry
- affidavit of marital status (certificat de célibat).
- registration of the birth certificate to the Tribunal de Grande Instance de Paris (for Parisians only), this registration is only required if one of the partners is a foreigner, the french partner does not required this.
When I say shared documents, I mean that you only need one copy of these documents for both, in this case one for you and your partner. The documents listed above "Shared documents" must be per person, meaning two copies of each.

Thank you so much for all this info,im foreigner trying to make a pacs here in france and its been kind of difficult to get anyone here to tell me or my boyfriedn the truth about this thing..we went to la maire the other day and some lady said we could not make a pacs ,because i was not french!(i actually got pissed off).
I've been here in france living with him since december 2007,i came here with a titre de sejour student to study french and to be together now a year has passed and he got transfered to a town in the south called AGEN...for the last four months his been traveling around with EDF so we had no time to make a pacs in paris or to renew my titre de sejour, wich expires at the end of this month)now that we are finally settle i hope the fact my titre de sejour expires soon wont be a problem for me to get a titre de sejour vie prive; in paris we lived together but the rent contract only had his name on it because, back when he rented it, i was still not in france, all i have to prove we where living together are the attestation de herbegement he made two times ,one time to get my titre de sejour etudiant and the other to renew it;also i have a few bank letters addressed to me at the appartement in paris. concerning this point we are asking his parents to make a letter saying we are together for more than a year ( a year at 3 months) and some friends too ..we also signed the both of us this time le bail for the appartement...
i hope u get what im trying to say i got this mix of languages in my head and im a bit worried..in conclusion do you think having my titre expire this month will affect the demand for the other one? and also wich other things i can put in the dossier that prove we live together..
thank u again!

Dominican girl,
I believe Spanish is good for you, right?
SI tienes alguna duda o pregunta dejame saber.
Hello,
Thanks for your post with a clean, detailed list of documents. I am trying to PACS with my french boyfriend (I'm mexican american) and I wanted to know whether I need a certified birth certificate. I can order one online that will take just a few days but it is not certified. The certified ones take 3-4 weeks at least and by then I won't be in France to be able to PACS so it's quite the dilemma. Thanks!
