Basic Introduction
What is PACS?
PACS is the abbreviation of Pacte Civil de Solidarité, and translated in English "civil pact of solidarity". This pact is a form of civil union between two adults, and these adults can be from the opposite sex or the same sex. This Act was establish on November 15, 1999, allowing the parties involved to organise their lives in a stable judicial context.
In some countries, like the U.S., domestic partnerships and civil unions (like PACS) are different. A Domestic partnership gives the partners less rights, however a civil union is more like a marriage. Domestic partnerships are normally only for same sex couples (with the exception to California State). Civil unions, on the other hand, are for both, opposite and same sex couples. This type of unions are not recognized in all states of the U.S. or in all countries.
Today, some people use this type of union to avoid marriage since is simpler and cheaper than a wedding, however this union does not substitute marriage. PACS gives rights and responsibilities to the parties involve like marriage would, but less than marriage. In France for example the couple can file taxes together like married couples do, however in other areas the partners can be considered single.
Can anyone get PACSed?
In order to PACS with someone, you and your partner
- can't be minors, not even independed minors.
- can't be married.
- can't be PACSed to some else.
- can't be blood relatives.
How can my partner and I get PACS?
First of all, you must go to "Greffe du Tribunal d'Instance" (Office of the Clerk of Court) in your area. The clerck of court must be where you live in or where you are going to declare your residence, meaning if you are planning to move, you'll need to address to the clerk of court there. A piece of paper with all the documents needed will be given to you, and you will need to make an appointment to sign the PACS.
